It’s the official Move-In Day at our local university, which means tired parents, scantily clad coeds, and lines of people ordering complex sugary coffee drinks. “Can I have a double caramel blueberry latte with pumpkin spice, three shots of banana, oat milk, and extra honey?” Great, honey, you enjoy that, I’ll get some Chardonnay poured for your mom. Prime is coming down here tonight to witness the spectacle and see if people are really as retarded as I tell her they are. (Narrator: They’re even worse)

One thing I did not tell the parents: I discovered a plot of psilocybe mushrooms growing (appropriately) behind the university’s administration building. This explains a lot.

Birthdays today include a guy who wasn’t one of the Wright Brothers; the great-great-grandpa of Instant Pot; the greatest cartoonist EVER and don’t even bother fighting me, it’s objectively true; a woman doing campaign commercials for the Democratic Socialists; my historical celebrity crush; a guy who was a real blast on Valentine’s Day; a writer who, let’s admit it, was very uneven;  a guy who created an inordinate number of my favorite TV shows; a TV cook with two things going for her; a guy who made the Raven say “nevermore”; and a fun general named after a zit.

      When i was in school, our LGB advocacy group had barely voted to add the B. The T was being used, but the organization had strong pushback. The Ls and the Gs barely tolerated each other, and they both hated the Bs.

      One summer I lived in a suite where the other 6 guys were Gs of the T variety. They could ve a hoot, but they were all dangerously insane too.

      All that goes to support my conclusion that I am surprised that the alliance has lasted this long.

        As for the T’s, it has been documented somewhere (I think Christoper Rufo wrote a long article about it) that Marxist cuntes back in the 50s or 60s deliberately pushed to make it happen and not out of the goodness of their hearts but to “smash the system”.

    I’ve been pondering this one lately. Thing is, this isn’t a moral absolute, derived directly from some sort of foundational principles. It is a legal framework put forth under a certain set of circumstances/conditions.

    In an era where every move and detail can be accurately recorded and stored indefinitely and mined and combined with other data sets, I’m not sure it should hold as a legal principle (that’s all it is really, not a foundational moral judgement).

    Do I ‘know’ that? Am I convinced that we should discard it? No. But I’m also not sure that simply repeating it as an inviolate bedrock of a legal system is correct either.

      The forefront of the legal battle may come from an unexpected place.

      The first time I heard the word FLOCK was from the guy with the monkey that had 2 Georgia police departments conspire against him, falsely accusing him of “following too closely” a couple of years ago.

      In the aftermath, as he was fighting the charges and suing the departments for their violations of his rights, he learns that those departments and another Georgia PD have been tracking his movements in Florida using FLOCK.

      So he initiates another lawsuit.

      During the discovery phase of that lawsuit, he gets some head-scratching decisions from the judge. Further investigation shows that this judge was acting as the city attorney for the town he is suing when they implemented the FLOCK cameras.

      You cant make this stuff up.

      So the judge has been forcibly recused, but his decision (apparently on his own motion) that spying on someone out of state over which you have no jurisdiction is not a search for 4th amendment purposes is now on appeal.

      The kid is still handling all of his legal matters himself.

      He shared his appeal – and it very closely follows the current controversy that is working through the legal sytem… that there has never been a determination of the line between a few photos of passing license plates and a persistent and pervasive surveillance across time and space.

      He researched all the prior cases, makes all the right arguments and paid his thousand dollars in court fees to file his appeal.

      Yeah, that is a thing. If you get a bad ruling from a judge, you have to pay the court to hear your appeal. About $650 in his case. Plus another $300 filing fee for each breif that is docketted.

      Kinda wild.

      So our fate on the legal status of the panopticon could rely on a little gay dude with a monkey and plenty of time on his hands who got pushed by Barney Fife and decided he wasnt gonna take it.

        That constitutional right to film what you can see in public? Not recognized at the supreme court level yet. At least 1 circuit still thinks recording police is only a 1st amendment issue if “something is happening”.         But that’s sort of the point, to the degree I’ve carefully thought through it. The LEGAL doctrine of “no expectation of privacy in public” was formulated/formalized when the extent of losing privacy in a public place was an recording of a single slice of time or a human observation. It was not formulated with near constant recording, ‘permanent’ storage, and linking across multiple databases in real time was the norm.

        Do we need a new formalism? I don’t know. But I hesitate to get locked into – “we’ve always done it this so we have to continue doing it this way.” especially when it’s not derived from what I consider bedrock moral principles – e.g. “though shalt not murder”, “thou shalt not suffer Tony Fauci to live”, to invoke the Christian formulation; the barrier to reconsideration is much, much lower when it’s, to my mind, simple a legal framework of convenience/balance of interests.

        Tonio is right, the knock-on effects are every bit as bad. What the direction things like this should take is a very strict level of gov’t being forced to not be allowed to use things like this, no matter the reason. No crossing jurisdicional boundaries, no holding on to records past legal requirements, and so on. And watchdog groups need to hold them accountable.

      How you have any kind of principled and workable exclusion from that for being photographed in public, I don’t know. As Tonio points out, requiring consent from every single person who shows up in a photo will kill journalism, and really any and all photography in public.

      The real issue seems to be the data mining part.

Oh, they can now rearrange silver atoms on a substrate to record a moment of time. Oh, now they can release electrons on a silicon substrate and record 0s and 1s in a digital medium. Oh, now they can string together multiple of those. Oh, now they can do that continuously, store it indefinitely, link it to other databases of the same from across the world, along with databases of biometric data in real time. Oh, and now it’s the government(s) doing this.

        Does the common sense idea that other humans can observe you in a public space extend to those situations? I’m not convinced it does, especially when it comes to the state doing the observing, recording, mining.

      Even more stupidly, social media from a small producer of chicken products has informed me (humorously) what those words actually mean. “Free range” does not mean running around in a field.     I was trying to be upbeat. It’s taken me ten days to get down to 275 again. Though this time it’s 275 on the dot (last time it was 275.6 but I doubt the precision of the scale to really give me tenths of a pound)

    It’s been 169 days since I first dropped below 300. But I can’t get dispirited. Otherwise I’ll be over 300 again in no time.

      My cancer medication gave me an extra 50+lbs that dont seem to move at all, regardless of what I eat.

      I spent the first 45 years of my life struggling to gain weight and muscle mass. Finally at a comfortable 180, my 50s took me up another 15 without asking.

      I thought that was trouble. Yeah, no. Been sitting at 250 basically since I started treatment.

      When I got to 190, I went to 1 meal a day, a grilled chicken breast and some steamed broccoli. I was back at a very lean 170 within a couple of weeks.

      This nonsense? A month of very little beyond broccoli had me down 3 lbs. But I fluctuate more than that across the day.

      Long story short… I feel your pain.

      The body fights back when you try to move it off of its set point. Keep in the fight!

        Out of curiosity, do cancer docs make nutritional recommendations these days? Personally, I’d do everything in my power to minimize blood sugar since cancers really like it, to the degree of generating local vasculature to deliver more of it to themselves. “Starve the Beast” so to speak.

        The nutritionist was fantastic if you are a rube who doesnt know anything about nutritionist.

      I’d expect that a graph of weight loss, besides naturally having fluctuations, would tend to go downward more slowly as you lose more weight. [Disclaimer: not by any stretch a mathematician, statistician, or dietitian.] You can do it! (Also, it’s bound to help if you find a form of exercise you enjoy doing regularly.)

        I ran some errands which is why I didn’t respond to other comments for a bit. Had a piece of Jarlsburg for brunch. The thing about eating less is that I can lower my price sensitivity on ingredients a bit.

        @Sensei – I stopped by the Asian Supermarket and looked at the Mochi (though I did not buy since the single serving pieces were 60g carb which is more than my daily allowance) They were Made in Japan. So there is a cheap export market Mochi from there. I know the discussion was a few weeks back, but I was in there anyway, so I looked.

        Related – How did I end up with a brand of fish sauce? I only rarely buy a bottle, and there’s always a multitude of options, but for some reason I always end up buying Red Boat. I don’t know how it compares to the other brands, but for whatever reason I stare at the shelf and grab that one.

    A. I got a job-job. It’s at the same place I was contracting transcription work with, but they had an opening I was uniquely qualified for, it pays more than I’ve ever made in my life, I’m 58 and need future security I don’t have being self-employed, and the benefits are better than my husband’s with a lot less money (although I’ve gotten used to living without any benefits and paying for some things out of pocket and you know what? I don’t mind). They sent me a laptop when I first started contracting with them last year, so I have their box, which I pretty much hate because (and I cannot tell you how many times I’ve gotten in trouble for sending myself shit back and forth from my own computer and what I can’t have access to on their box [e.g., Dropbox] and the software requests that have been denied and the limited mod options so ugh) its mod options are limited, meaning I have to learn new apps that aren’t as good as the ones I’ve been using for years.

    B. I have my trusty gaming laptop ALSO, which is my baby.

    But, you know, I’m an IC going along doing my thing with a simple KVM switch.

    ANYWAY. So this new job necessitated (not required) that I get a second monitor, which I have been resisting since forever, but finally just said, no, my ALT and TAB keys are going to wear out.

    Do you know that two boxes and two monitors are Not A Thing? They are not. I mean, not in any demand as to make a difference. Anyway. I had to lay out a shit ton of money for a KVM switch that would accommodate two boxes and two monitors and I fucking did it (thanks, ChatGPT!).

    Please ignore the cable management. I haven’t gotten that far yet.

        I set this up Tuesday night (when I still had work to get done urgently) and finished the setting up about midnight. I haven’t had a chance to straight it all out, but this is intolerable.

        Also, I hand-write a lot of stuff, so I shove my monitor(s) back and forward. I’m going to move my laptops and put the and the switch on a board I can slide back and forward as a unit. That is today’s task.

        Cable management is overrated! Except when you have to add, change, clean, repair, relocate, find the thing that rolled behind the monitor, have a cat who likes it behind the monitor, reset the modem, or… ok, I should probably do some cable management.

        Also, I have some odd peripherals. Footpedal*, natch, headphones that I had rejigger. Those are shared. Then for mine I have a 7-port hub, an external hard drive, and an external DVD drive so that all had to be mapped out.

        I can appreciate good cable management. There is little more elegant than a properly managed datacenter’s endless cascade of cables.

        For a home setup, it might be overkill to go as far as they do in a professionally managed datacenter.

      I am flying around the house half-unpacked trying to tackle a dozen different mini-projects at the same time and it’s wearing me out. I finally got the shower curtain up so it might be time to take a shower.

      I have to return to work Monday and I have no idea where I’m going to shoehorn my work desk yet.

    The 6yo will be here soon and he’s staying the night. Storm went through last night, taking the heat off — and it may storm again — but he’s still keen on doing the Lemonade Stand again. He made some bank last time, $60 over two days, I’m told. (Much creative accounting by customers not wanting change.) After that, I believe we’re going to a very fun indoor playground, with foam pits and much climbing and bouncing.

    Applied to two more solid leads, last night. Two complementary Title Specialist gigs at one firm, and for Title Specialist and Document Agent at another. (Docu… AGENT MAN! Docu… AGENT MAN!) All should pay $20-$22 or so, and I’m rather interested in this work. It’s apparently the same as escrow processing but much much much more simple. That’s good, tho only getting *maybe* seven days to ‘learn’ the last gig, in slipshod fashion, was assuredly my problem at the last gig.

    I rather hope one (or both!) of those places rings me up fairly soon. It would be really nice to have a steady, normal schedule and with that money, even the lower end, that’d be enough to get me ‘out’ of here in six months or so.
